Service Agreement
Please read carefully. This Service Agreement governs your access to the Behery Dental platform. It works alongside our Terms of Service and Privacy Policy.
1Introduction
This Service Agreement (“Agreement”) explains the terms under which Behery Dental (“Behery Dental,” “we,” “us,” “our”) provides access to our platform and related services.
By creating an account, checking “I agree,” or using the Behery Dental platform, you acknowledge that you have read, understood and agree to be bound by this Agreement. If you do not agree, you may not use the platform.
This Agreement is entered into by the dental clinic organization that creates a Behery Dental account, and applies to all of that organization's team members who use the platform on its behalf, including anyone the organization adds with the role of owner, admin or member.
2Nature of Services
Behery Dental provides a digital workflow platform, together with case design and production-file services, that supports:
- Case tracking through a defined status workflow — submitted, treatment planning, file preparation, delivery, completed
- Submission of a case for design and production files — where Behery Dental prepares the agreed design and files according to the treatment plan your organization's treating dentist reviews and approves
- Case-scoped communication and workflow tools
- Secure, access-controlled case file storage, including intraoral scan files (STL/PLY/DCM) and related case documentation
Behery Dental is a single platform for dental clinic organizations. There is no separate lab or production-partner organization type, and no marketplace matching or brokering between organizations. Behery Dental prepares design and production files; it does not manufacture restorations or appliances. Your organization may manufacture in-house or use an independent third-party manufacturer of its choice, and is responsible for that selection and relationship.
Clinical Disclaimer
Behery Dental does not:
- Provide medical, dental or orthodontic diagnosis, treatment selection or clinical supervision
- Offer clinical advice, or substitute for the judgment of your organization's treating dentist
- Validate or guarantee the clinical accuracy or suitability of a treatment plan for a given patient
Where Behery Dental performs design and production-file work for a case, it does so according to the prescription and treatment plan reviewed and approved by your organization's treating dentist. Your organization's treating dentist remains responsible for diagnosis, treatment selection and clinical oversight. Your organization remains responsible for all clinical decisions, regulatory compliance, the manufacturer it selects, and patient outcomes.
3Your Responsibilities
3.1 Compliance & Professional Obligations
You agree to:
- Comply with all applicable dental, medical device and privacy laws in your region
- Obtain valid patient consent before uploading any identifiable data
- Verify, review and approve all treatment plans, designs and production files before they are released for fabrication
- Ensure that any device fabricated from uploaded files complies with your jurisdiction's requirements
3.2 Data Accuracy & Confidentiality
You confirm that:
- All information you upload is accurate and lawful
- You will limit unnecessary patient identifiers when uploading files
- You will maintain confidentiality of all case-related information and platform materials
- You will not share credentials or misuse access
3.3 Reviewing Design & Production Work
You understand that:
- Your organization's treating dentist must review and approve each treatment plan, design and production file before it is released for fabrication
- Your organization is responsible for verifying that any device fabricated in-house or by a third party matches the approved treatment plan before it is used on a patient
- Behery Dental prepares the agreed design and production files, but is not responsible for the clinical judgment behind the plan or the fabrication process
4Our Responsibilities
Behery Dental will:
- Provide access to the platform and its features
- Support case-status tracking, treatment plan review, file exchange and messaging for cases your organization submits
- Perform the agreed design and production-file work for cases your organization scopes to Behery Dental, according to the treatment plan your organization approves
- Maintain commercially reasonable security and availability
- Provide reasonable-effort support
- Handle information in accordance with our Privacy Policy and Data Processing Agreement
Behery Dental does not guarantee:
- Clinical accuracy
- Treatment outcomes
- Fabrication or manufacturing quality
- Uninterrupted platform availability
5Fees
Every clinic organization is linked to a monthly subscription plan, which sets a monthly price, the number of team-member seats included, a monthly case-volume allowance, and a standard per-case overage price. Behery Dental staff activate or change your organization's plan after agreeing on pricing with you directly — your organization cannot change its own plan from within the platform.
Billing is handled manually: our staff generate an invoice, optionally tied to your plan, with a secure payment link, and mark it paid once payment is confirmed. There is no automatic recurring billing and no stored payment method on file for your organization.
If your organization submits more cases in a calendar month than your plan's case-volume allowance, the excess is billed at your plan's standard per-case overage rate, also invoiced manually.
This subscription fee, together with any per-case overage, is Behery Dental's charge for platform access and for any design and production-file work Behery Dental performs for your cases. Any pricing applicable to your account will be communicated to you and agreed before being charged.
6Confidentiality
6.1 Information We Protect
Behery Dental will maintain the confidentiality of:
- Case data and patient-related information
- Business information shared through the platform
- Any information identified as confidential
6.2 Your Confidentiality Obligations
You agree not to disclose:
- Another organization's confidential information
- Internal Behery Dental processes or non-public features
- Screenshots, documentation or system details intended only for users
7Intellectual Property
7.1 Your Data
You own:
- Your case records and patient reference codes
- Case information
- Files you upload
- Treatment plan approvals
7.2 Behery Dental IP
Behery Dental owns:
- The platform
- Software and algorithms
- Workflows and user experience
- Branding, documentation and content
- The design and production-file methodologies it uses when performing work for your cases
7.3 Use of Anonymized Data
You grant Behery Dental a license to use anonymized and aggregated data to:
- Improve platform features
- Train and optimize AI-assisted tools
- Conduct analytics and usage analysis
We do not use identifiable patient data for marketing or commercial sale.
8Data Protection
8.1 Global Frameworks
We comply with applicable requirements under:
- GDPR (EU/UK)
- CCPA/CPRA (California)
- PIPEDA (Canada)
- Applicable APAC privacy laws
- U.S. data protection principles
8.2 Middle East and North Africa
Because our initial and primary market is the Middle East, we also comply with applicable requirements under regional data-protection laws, including:
- Saudi Arabia — the Saudi Personal Data Protection Law, its Implementing Regulations, and the Regulation on Personal Data Transfer Outside the Kingdom
- United Arab Emirates — Federal Decree-Law No. 45 of 2021 Concerning the Protection of Personal Data, Federal Law No. 2 of 2019 for health data processed in connection with UAE health services, and, where applicable, the DIFC Data Protection Law or ADGM Data Protection Regulations for free-zone entities
- Egypt — Personal Data Protection Law No. 151 of 2020 and its implementing requirements
- Qatar — Law No. 13 of 2016 Concerning Personal Data Privacy Protection, and the QFC Data Protection Regulations and Rules for QFC-established entities
- Bahrain — Law No. 30 of 2018 with Respect to Personal Data Protection
- Oman — the Oman Personal Data Protection Law issued under Royal Decree No. 6 of 2022
- Jordan — Personal Data Protection Law No. 24 of 2023
- Morocco — Law No. 09-08 concerning the protection of individuals with regard to the processing of personal data
- Algeria — Law No. 18-07, as amended, concerning the protection of individuals in the processing of personal data
- Tunisia — Organic Law No. 2004-63 concerning personal-data protection
Where UAE health-data rules or another jurisdiction's health-data residency requirements apply, we will not store, process, generate or transfer the relevant health information outside the required territory unless an applicable legal exception, decision or authorization permits it — which may mean using an approved in-country hosting environment, restricting certain workflows, or declining to accept a case where compliance cannot be confirmed. Full details of these regional obligations, including country-by-country transfer conditions, are set out in our Privacy Policy.
8.3 Hosting and Security
Your data is stored securely using Supabase, which utilizes encrypted storage, row-level security and SOC2-grade infrastructure. Each production environment is assigned a primary hosting region, and a jurisdiction-specific hosting environment may be used where local health-data or data-residency laws require it.
A separate Data Processing Agreement (DPA) applies where required by law. See our Privacy Policy for full detail on data-protection roles, legal bases, retention, international transfers and individual rights.
9Termination
This Agreement remains effective until terminated.
Behery Dental may terminate or suspend access immediately if:
- You violate this Agreement
- Your actions create safety, legal or compliance risks
- You misuse the platform or access data improperly
You may terminate your account at any time.
Upon termination:
- Platform access may be disabled
- You should export any required data before termination
- Behery Dental may retain anonymized data for analytics and compliance
10Limitation of Liability
To the maximum extent permitted by law:
- Behery Dental is not liable for treatment outcomes, fabrication or manufacturing issues, or clinical decisions
- Behery Dental is not responsible for delays or errors caused by third-party software or services outside its control
- The platform is provided “as available,” without clinical guarantees
- Behery Dental's total liability is limited to the amount you paid directly to Behery Dental in the preceding 12 months (if any)
You agree to indemnify Behery Dental against claims arising from:
- Clinical decisions
- Fabrication or manufacturing defects
- Regulatory breaches
- Improper handling of patient data
- Misuse of the platform
11Governing Law

The Parties agree to attempt resolution through good-faith discussion before pursuing legal action.
12Acceptance of This Agreement
By:
- Creating a Behery Dental account
- Checking “I agree to the Service Agreement”
- Using or accessing the platform
You confirm that you:
- Have read and understood this Agreement
- Accept full responsibility for all clinical and regulatory decisions
- Agree to the Behery Dental Terms of Service and Privacy Policy
- Are authorized to accept this Agreement on behalf of your organization
